How Would Emancipation Affect My Child Support Payments?

In family law, an emancipated child is one who is no longer under the control of his or her parents. If you are the parent of an emancipated child and have been paying child support, this means that you are no longer responsible for paying child support. In Indiana, a child is emancipated at the age of 19. However, there are several circumstances that would merit a child becoming emancipated prior to turning 19 years of age.

Conditions For Emancipation Of A Child Before The Age Of 19

You may be successful in terminating/modifying child support if one of the following is true:

  • The child has joined the United States military
  • The child has married
  • The child is not under the control or care of either parent

Additionally, the child must be at least 18, have not attended postsecondary school (such as college) in the past four months, not be currently enrolled in postsecondary school and able to support himself or herself.

Emancipation In Regard To Higher Education

A child who is emancipated may still receive financial support for educational expenses, including college or trade school. Financial support for education is different from child support and includes tuition, room, board, books and more.

What If One Child Is Emancipated?

If you have more than one child receiving child support and one of them has been emancipated, child support will not be automatically divided by the number of children. Rather, the court will lower the payments equitably to ensure that each child receives the necessary support.
