What Is Collaborative Law?

One of our Indianapolis family law lawyers, Jordyn Katzman McAfee, is certified in collaborative law. For Ms. McAfee, collaborative divorce offers her clients the environment and opportunity to deal respectfully and fairly with their spouses in dissolving the marriages. The focus in collaborative divorce is on promptly reaching a fair, out-of-court settlement — not on winning or losing — so that both parties can move forward with their lives.

In a collaborative divorce, both spouses will have a collaboratively trained divorce attorney. Both parties and their attorneys will sign an agreement that states they will reach an out-of-court divorce settlement. The attorneys then assist the clients in negotiating that settlement. The legal decisions are not imposed by judges. Rather, each spouse plays an integral role in making decisions regarding the divorce and its related issues such as:

  • Child custody and visitation
  • Property division
  • Spousal support
  • Other family law issues

In the vast majority of cases, collaborative law is highly effective. However, if the collaborative process fails and the matter must be taken to court, each party will need to retain a new attorney.
